Un Contrato de Servicios de Fotografía es un acuerdo entre un / fotógrafo o fotoperiodista y un cliente. Este tipo de contrato de servicios es útil debido a que establece los términos y condiciones del contrato. ¿Qué tipo de fotografías desea el cliente que se produzcan? ¿Cuánto y cuándo se le pagará al contratista? ¿Existe cualquier tipo de restricción establecida con respecto a la ubicación del contratista al momento de estar tomando las fotografías? ¿Qué tipo de equipo o modificaciones deberá de proporcionar el cliente? Todas estas preguntas serán contestadas en el contrato. Además, el contrato reafirmará que no se crea una relación de empleador / empleado.

Incluye la información de contacto del fotógrafo y del cliente. Incluye los nombres completos, los domicilios, las direcciones de correo electrónico y los números de teléfono celular y particular. El fotógrafo también debería proporcionar un sitio web si está disponible

Event Photography Contract.                                      Contrato para Evento de Fotografia

1. It is understood this Studio/Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract. Simultaneous coverage by another photographer with professional still photography equipment releases Studio/Photographer from this contract.

2. Payment Policy: A non-refundable retainer of 30% of package will reserve Studio/Photographer for coverage on the specified date and will be applied to the Package. The remaining balance is DUE 14 DAYS BEFORE EVENT.

3. Price Protection: The Studio/Photographer warrants all prices quoted for professional services, photographs and albums are valid for a period of six months following the date of the event. Orders placed after that are subject to the studios current published pricing.

4. Copyrights: As the author of all images made hereunder and as provided for by United States Copyright Laws (Title 17, U.S. Code Section 101), the Photographer shall retain the copyrights in perpetuity, regardless of possession or ownership of photographs, digital files or any other format of reproduction. Client may not reproduce images in any manner without Photographer’s explicitly written permission. Client recognizes and agrees that the Photographer may reproduce, publish (including internet), exhibit and otherwise use images created hereunder, without specific identification of persons or events, (1) as samples of work to be shown to prospective clients,(2) for instructional purposes, (3) as samples of work to be displayed for marketing or competition.

5. Requested Photos: While Photographer will make every reasonable effort to take photos specifically requested by Client, Client understands that this is an uncontrolled event and that due the vagaries of the weather, available light, time restrictions, and willingness of subjects, Photographer cannot possibly guarantee that ALL requested photos will be taken.

6. Cancellation: Upon acceptance of these terms, the Photographer reserves the time and date for Client and will NOT make any other reservations for that time. For this reason, the retainer is non refundable, even if Client cancels the order for photography, or changes the date of the event. However if the Photographer is able to contract another event of at least equivalent value for the cancelled date, the retainer will be refunded. The Photographer warrants that in the event of a cancellation, reasonable effort will be made to secure a replacement assignment.

7. Limitation of Liability: While every reasonable effort will be made to produce and deliver outstanding images of the event,the Photographer’s entire liability to Client for any claim, loss, damage or injury arising under or relating to the Agreement or the Photographer’s performance hereunder, including the negligence of the Photographer, is limited to a refund to Client of all fees pad for services. In the unlikely event of personal illness to The photographer, all reasonable efforts will be made to find a suitable replacement Photographer. If Client rejects substitute Photographer, Client may terminate this agreement and receive a full refund of the retainer paid to the Photographer.

8. Proofs: Proofs should not be construed as an indicator of quality of the final product. Final Print images may have additional retouching applied for a consistent and pleasing presentation. “Proofs” means the images selected by Photographer in its sole discretion for presentation or delivery to Client. Such selection shall constitute all images that will be made available to Client and, once selected, shall be deemed as fulfillment of the Proofs section of the package. Proofs may or may not include artistic enhancements or touch-ups. Digital files are retained on the Photographer’s computer systems for 24 months.

9. Website: A presentation of the proof images is ordinarily made available online on a password protected website within four weeks following the event. Client agrees to allow Photographer to distribute a small notice to guests with the web address of event and event ID information. Online gallery is available for 30 days.

10. Wedding Albums: After receiving layout proofs, client has 45 days to provide their revisions to Photographer for inclusion into album. If client does NOT provide their revisions in writing, or email, within the 45 days, they forfeit any choices of images included in the album. As part of the service, the Photographer will design the layout of albums including photograph size and image placement. The custom designed album is usually ready 2-4 months after client approval of layout.

11. DVD Galleries (if purchased): The images to be used in the DVD Gallery slideshow will be selected by the Photographer. Images in slideshow may include artistic enhancements or touch- ups. Royalty free music will be used unless client provides written permission from the recording company to use copyrighted music in the slideshow.

12. Ordering Individual Photographs: Orders for reprints and enlargements can be accomplished online via the password protected website within the month they will be posted. Unless otherwise specified, custom orders will be delivered within 2-4 weeks following payment for order. The online gallery is available for 30 days.

13. Meals: In order for Photographer to make arrangements for her and her associate, they request information about whether meals will be provided or not. (Do NOT feel obligated, Photographers just needs to plan accordingly.) __ Yes __ No

A note about Releases/Una nota sobre Releases:

Privacy issues typically arise when an image is used for purposes of trade or advertising. That is, it’s not the picture, but how it is used that determines the need for a release. If you are on an advertising assignment, you will need to collect releases from every person in your shots. You are always better off if you have permission to photograph your subjects and can prove it.

MODEL RELEASE/MODELOS

Este es un contrato que se obtiene de una persona cuyo rostro es reconocible en la fotografía que se mostrará al público o de uso comercial. A continuación se muestra un ejemplo de un acuerdo/contrato de modelo sencillo que es sugerido por la asociacion de PPA o Professional Photographers of America.

It is also important that the photographer understands the contents of this legal  Document. Some of the key terms to understand include the following:

  • Assign – This refers to the person or company to whom the photographer has sold the license or rights to release the photos in public. The photographer may still retain the rights to the photos, but licenses a company (the assignee) to commercially use the photo.
  • Consideration – This refers to the compensation or anything of value that is given to the person whose face is recognizable in the photo. The compensation is given in exchange for the rights released by the person.
  • Images – The generic term for the photos, this can be in photographic film or digital recording.
  • Model – The person in the photos whose face, likeness, and form are recognizable.
  • Media – This refers to all modes, forms, channels, and vehicles in which the photographer utilizes the image. It can be print, film, digital, television, electronic, and other methods already known or will be invented.
 TFP or “Time for Print”
Is a mutually beneficial agreement between a model and a photographer who are attempting to launch their individual careers.
this is a legal agreement between a photographer and a model, in which the latter agrees to model for the former for no financial compensation except for the free photographs which will be used for the model’s
portfolio.

Besides dividing the expenses for the photo shoot, the photographer and the model should also arrange the compensation they get from each other. For example, they should agree on how many pictures will be provided and how long the modeling session last. The usual arrangement is two medium-size photos for every hour of modeling. But this will vary, depending on the photographer and the model.
 finally, if the photographer intends to use the pictures for commercial purposes, he or she must decide if the model will be paid upfront with a fixed amount and have an additional agreement, the model release form, or agree on a 50-50 arrangement on the money that can be earned by the photos.
The photographer should carefully study the TFP contract before having the model sign it. If there are plans to use the pictures commercially, the TFP contract should have a clause, in which the model consents to the commercial use of the photos.

The Model releases the Photographer and/or his/her assigns from any liability due to the publication of the Photos unless it can be undoubtedly proven that the use of the Photos was malicious and intended to publicly present the Model in an unfavorable light.

The Model confirms that all poses, positions, and situations presented in the Photos were entered into willingly, without force or coercion. The Model also states that he/she did not breach any prior contracts when this contract was formed.

Both the Model and the Photographer have read and agreed to the foregoing terms and conditions.

PROPERTY RELEASE:
  • Si un fotógrafo planea tomar fotos de una propiedad privada y reconocible parafines comerciales, el documento necesario es el Acuerdo de Autorización de la propiedad. Este acuerdo obtiene el consentimiento del dueño de la propiedad.

I have read and understand this agreement, including the terms and conditions, and agree to be bound by them.

 Terms and Conditions

 

  1. It is understood that this Photographer/Studio is the exclusive official photographer retained to perform the photographic services requested on this Contract.
  2. Studio/Photographer may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.
  3. No part of any order, including previews, will be delivered until the balance is paid in full.
  4. The Studio/Photographer reserves the right to use images created under this contract for advertising, display, publication, or other purposes. The client signing this contract warrants that he/she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Studio/Photographer in the event of litigation arising out of such use. Negatives, digital files, and previews remain the exclusive property of this Studio/Photographer.
  5. Upon signature, the Studio/Photographer shall reserve the time and date agreed upon. Unless the Studio is able to fully replace the cancelled reservation, all sitting fees and deposits are non-refundable, even if the portrait is rescheduled or cancelled for any reason other than inclement weather.
  6. If, in the opinion of photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the Studio/Photographer, the photographer may elect to use an alternative location or reschedule the portrait.
  7. If the Studio/Photographer cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return any deposit or sitting fee to the client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event that the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
  8. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of the dyes, and Client releases the Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

The Right to Publicity:  Los Derechos a Publicidad:
For photographers and their clients, the right of publicity can become a problem when people become celebrities after you have taken their picture. It can especially be a problem with crowd scenes. Rights of privacy, which die with the persons to whom they belong, rights of publicity survive their owners and can be passed along for generations.

Property owners’ rights: Derechos de Propiedad:  Privacy and defamation cannot apply to objects (although defamation can apply to business entities). Things — cars, buildings, statuary, costumes, animals, etc. don’t have legal rights. But the people who are closely associated with those objects do have rights and could claim that your photo of their property has caused harm. 

 

Digital Manipulation:  Manipulación Digital:   Nowadays it is routine to alter colors, morph shapes and assemble scenes by compositing portions that were separately shot. Your release should state that the subject gives permission for this to occur, and because Photoshopping has become a normal aspect of advertising photography, it should be included in all your contracts.       “I hereby release Photographer from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of such photographs or in any subsequent processing of them.”

Depending on the model’s concerns (and the client’s needs, of course), you may need to accept certain limits on the digital reworking that may be done. For instance,      “However, this compositing or distortion shall be done only by Photographer or by persons working under the direct supervision of Photographer, and it will be limited to images and image components that are photographed on the same day.”
